A Far North Queensland man has been sentenced to eight years in prison for a vicious torch attack on his former partner, leaving her with severe burns and permanent scarring.
The Attack
Josh David Davies, 31, pleaded guilty in Cairns District Court to one count of grievous bodily harm. The court heard that on the night of January 15, 2023, Davies went to the woman's home in Manoora, Cairns, after she ended their relationship. He was armed with a torch and a knife.
Upon arrival, Davies forced his way into the house and attacked the woman, striking her multiple times with the torch. He also used the knife to threaten her. The attack left the victim with a fractured skull, burns to her face and body from the hot torch, and permanent scarring.
Victim Impact
In a victim impact statement read to the court, the woman described the ongoing trauma and fear she experiences. She said she lives in constant fear of Davies and has undergone multiple surgeries. The court heard she now suffers from anxiety, depression, and post-traumatic stress disorder.
Sentencing Remarks
Judge Julie Dick described the attack as "vicious and cowardly," noting that Davies had a history of domestic violence. She said the offending was aggravated by the use of a weapon, the sustained nature of the attack, and the lasting harm caused.
Davies was sentenced to eight years imprisonment with a non-parole period of five years. He will be eligible for parole in 2028. The court also made a domestic violence order protecting the victim for 10 years.
Domestic Violence Context
This case highlights the serious issue of domestic violence in Queensland. According to Queensland Police, domestic violence incidents have increased by 12% in the past year. Advocacy groups urge victims to seek help through services like DVConnect and 1800RESPECT.
The attack occurred just days after the woman ended the relationship, demonstrating the heightened risk during separation. Experts advise that leaving an abusive partner is often the most dangerous time for victims.
Legal Consequences
Davies' guilty plea was taken into account in sentencing, but the judge emphasized the need for general deterrence. The sentence sends a clear message that domestic violence will not be tolerated.
The victim expressed relief at the sentence but said she will carry the physical and emotional scars for life. She hopes her story encourages other victims to come forward and seek justice.
