Perth Rideshare Driver Granted Bail Variation After Fatal Crash
A Perth rideshare driver, who allegedly worked for up to 22 hours before falling asleep behind the wheel and causing a crash that killed a 7-month-old baby, has been allowed to continue working as a professional driver under revised bail conditions. On Monday, an Armadale Magistrate approved a variation to the bail conditions of Rajwinder Singh Grewal, permitting him to work as a freight driver, subject to a strict curfew between 9am and 4pm.
Details of the Tragic Incident
The 35-year-old driver was allegedly operating as a rideshare driver and was behind the wheel of a silver Toyota Kluger carrying three passengers when he fell asleep at approximately 3.40am on March 28. His vehicle subsequently slammed into a tree, resulting in the tragic death of a 7-month-old infant and injuries to a woman and another young child. Police have obtained dashcam footage from inside the car, which reportedly shows Mr Grewal briefly falling asleep multiple times prior to the crash.
Legal Arguments and Defence Claims
Defence lawyers argued in court that Mr Grewal had taken breaks throughout his workday to return home and rest. In advocating for the change to his bail restrictions, his lawyer emphasised that he has not been accused of speeding or driving under the influence of alcohol, but rather of driving while fatigued. Mr Grewal is currently charged with one count of dangerous driving occasioning death and two counts of dangerous driving occasioning bodily harm.
Court Proceedings and Future Hearings
During the court appearance, Mr Grewal wore a face mask, glasses, and a cap as he left the Armadale Court. No pleas have been entered to the charges at this stage, and he is scheduled to face the Perth Magistrates Court on August 11 for further proceedings. The case has sparked significant public interest, highlighting concerns over driver fatigue and safety regulations in the rideshare industry.
